Abstract
Jason Lowther, University of Plymouth, discussed European court cases related to waste, environmental impact, conservation, and pesticides. In the case of Antonelli and Provincia di Macerata, the European Court of Justice (ECJ) was asked for a preliminary ruling in relation to Directive 75/442/EEC on Waste (OJ 1975 L 194/39) and Decision 2000/532/EC relating to the establishing of lists of wastes and hazardous wastes. The Conservation case concerned the claimant's, R (Boggis), application for judicial review of a decision by Nature England to notify and confirm a site of special scientific interest (SSSI), which comprised a section of the Suffolk coastline at Eastern Bavents. In the case of Downs versus Secretary of State for Environment, Downs sought a judicial review of the Secretary of State's decision not to apply mandatory buffer zones, where pesticide spraying was not permitted around agricultural land in order to protect rural residents from the effects of the use agricultural pesticides.
